Kargil Bar Association extends suspension of judicial work till September 30 over High Court Bench demand

Kargil: The Bar Association Kargil has unanimously decided to extend its ongoing suspension of judicial work till September 30, reiterating its demand for regular sittings of the High Court Bench at Kargil along with Leh.

According to a resolution passed by the General Body on September 24, the suspension of judicial work, which began on September 17, will now continue up to and including September 30, making it a total of 14 consecutive days.

The Bar Association said its demand relates to regular sittings of the High Court Bench at Kargil and clarified that it does not oppose the functioning of the Bench at Leh.

The association said it had submitted representations to the Chief Justice of the High Court of Jammu and Kashmir and Ladakh and the Lieutenant Governor of Ladakh, seeking regular sittings of the Bench at Kargil.

The resolution also referred to the September 22 decision under which the Lieutenant Governor of Ladakh, on the recommendation of the Chief Justice, approved Leh as the initial place of sitting of the High Court Bench in Ladakh.

The Bar Association said it was disappointed that its representations seeking an arrangement for Kargil had not resulted in regular sittings at Kargil. It added that the development had caused disappointment among litigants and members of the general public in the district.

The association said it continued to hope that the Chief Justice and the Lieutenant Governor would consider its demand for regular sittings of the High Court Bench at Kargil.

During the suspension period, members of the Bar Association have resolved not to appear before any court within or outside Kargil, including the High Court of Jammu and Kashmir and Ladakh. They will also not undertake notarial work or issue notary attestations during the period.

The association has requested judicial officers and presiding officers of revenue courts in Kargil not to pass adverse orders against parties or litigants because of the non-appearance of counsel during the suspension. The Bar Association said it would continue pursuing its demand through lawful and peaceful means and review the situation after September 30 before deciding its future course of action.
