Article 370: Petitions Come to Naught, SC Upholds August 5th Decision

Srinagar 11 Dec (CNS): After hearing of several petitions, which argumented for the restoration of Article 370, the Supreme Court of India on Monday pronounced a verdict against the reinstating of the special status of J&K.

As per reports, the Chief Justice of India D.Y. Chandrachud said that Article 370 was a temporary arrangement owing to the war conditions in the erstwhile state and buttressed his decision by putting forth the Article 370’s textual reading, which he said indicated the provision’s temporary nature.

Regarding the J&K’s Legislative Assembly elections, CJI directed the Election Commission of India to take steps for conducting the same by 30th September of next year. It was also said that the restoration of statehood should be done as soon as possible.

The special status given to J&K by Article 370, under the Constitution of India, was abrogated on 5th August 2019 and subsequently the erstwhile state was bifurcated into J&K and Ladakh Union Territories. The move and the procedure that was undertaken to effect the dramatic change was challenged by the regional political parties and other entities, calling it a “unilateral” and “unconstitutional” decision.

Pertinent to mention that an unease was palpable across Kashmir after people came to know that the verdict on Article 370 was around the corner. (CNS)
